Obesity as a Secondary VA Condition in 2026:
The Strategic Link the VA Keeps Fighting

Successfully helped veterans win hundreds of claims

The VA is still aggressively denying obesity as a secondary condition in 2026 — often with language that feels like fat-shaming. Many raters call it a “lifestyle choice” even when service-connected conditions (PTSD, knee/back pain, medications, limited mobility) clearly caused or worsened it.

Why Obesity Is a Powerful Strategic Link

Obesity itself is rarely rated directly, but it is one of the strongest **intermediate links** in VA claims. It connects service-connected conditions to other major ratings like Obstructive Sleep Apnea (OSA), fatty liver, hypertension, diabetes, and more. For 100% veterans, proving functional impairment from obesity can also support higher Special Monthly Compensation (SMC) levels.

The Collins Case & Current VA Resistance

Following *Adams v. Collins* (CAVC, July 2025), obesity can be service-connected if it causes significant functional impairment. Yet many raters continue to stonewall these claims using boilerplate language, even when there is clear medical evidence.

Real-World Strategy That Works

  1. Use obesity as an **intermediate step** — Show how service-connected conditions caused weight gain, which then caused or worsened OSA, fatty liver, etc.
  2. Emphasize **functional impairment** (mobility limits, pain, fatigue, inability to exercise, etc.) in your statements.
  3. File a strong 21-4138 referencing *Adams v. Collins* and requesting a predetermination hearing.
  4. Use the VA’s own words against them when they previously acknowledged the connection.

I Can Help You

While helping veterans with hundreds of claims, I’ve seen obesity used successfully as a strategic bridge — especially for OSA denials and SMC claims. If the VA is fighting your obesity-related claim, I can review your C-File and give you targeted guidance.
